1. Agreement to Terms
1.1 These Terms of Service (these "Terms") form a legally binding agreement between you and Muhammed Rijas, who independently develops and operates the Vivaram platform ("Vivaram," "we," "us," or "our"). Vivaram is not currently operated by a registered company or incorporated entity; it is an independently operated technology platform. The "Vivaram Team" means the individuals authorized by Muhammed Rijas to assist in developing, maintaining, operating, moderating, or supporting the Services; references to the Vivaram Team describe operational roles only and do not create a separate legal entity, partnership, or joint venture.
1.2 These Terms govern your access to and use of the Vivaram mobile application, the Vivaram website, and all related features, content, and services (collectively, the "Services").
1.3 By creating an Account, accessing, or using the Services — including browsing as a Guest User — you confirm that you have read, understood, and agree to be bound by these Terms, together with our Privacy Policy and Community Guidelines, which are incorporated into these Terms by reference. If you do not agree to these Terms, do not access or use the Services.
1.4 If you use the Services on behalf of another person or entity — for example, when submitting a notice on behalf of an organization or department — you represent that you are authorized to accept these Terms on that person or entity's behalf, and "you" in these Terms includes that person or entity.
1.5 Certain features may be subject to additional terms presented at the point of use, such as rules for a specific feature, event, or program. Those additional terms supplement these Terms; if they conflict, the additional terms govern for that feature only.
1.6 These Terms do not create any partnership, joint venture, employment, or agency relationship between you and Vivaram. Your participation in the community is voluntary, and nothing in these Terms entitles you to compensation for your participation or contributions.
2. Definitions
2.1 In these Terms, unless the context requires otherwise:
- "Account" means a registered user profile used to access account-based features of the Services.
- "Anonymous Post" means Community Content displayed to other users without revealing the author's identity, while Vivaram retains the internal account association described in Section 14.
- "Community Content" means any content created, posted, submitted, or transmitted by users through the Services, including community reports, questions, answers, notices, event listings, comments, replies, correction requests, and associated metadata.
- "Community Guidelines" means any published rules, standards, or policies governing conduct and content on the Services, as amended from time to time.
- "Guest User" means a person who accesses publicly available parts of the Services without registering an Account.
- "Naatile Samsaram" means the community reports feature of the Services, through which users share first-hand local information and experiences.
- "Privacy Policy" means the Vivaram Privacy Policy available at https://getvivaram.com, as amended from time to time.
- "Verified Badge" means an indicator applied to an account, organization, department, or item of content following review by an authorized moderator or administrator, as described in Section 13.
- "Vivaram Team" has the meaning given in Section 1.1 and describes operational roles only, not a separate legal entity.
- "you" or "user" means any individual who accesses or uses the Services, whether as an Account holder or a Guest User, and includes any person or entity on whose behalf the Services are used.
2.2 Interpretation. In these Terms: (a) headings are for convenience only and do not affect interpretation; (b) "including" and similar words mean "including without limitation"; (c) words in the singular include the plural and vice versa; (d) references to a law include that law as amended, re-enacted, or replaced; (e) references to Sections are to sections of these Terms; and (f) if any provision of these Terms conflicts with a mandatory right you have under applicable law, that right prevails to the extent of the conflict.
3. The Services
3.1 Vivaram is a hyperlocal community information platform. The Services allow users to discover, create, and share local information, including:
- Naatile Samsaram (Community Reports): first-hand reports about local matters, experiences, and issues;
- Questions: community questions and answers on local topics;
- Government Notices: user-submitted notices concerning government announcements, schemes, and public administration;
- Local Events: listings of events in a locality, with dates, venues, and RSVP functionality;
- Public-interest information: weather information, market prices, lottery results, electricity outage updates, train timings, bus timings, and similar local public information;
- Explore: discovery of content relevant to nearby or selected localities;
- Notifications: a notification center and optional push notifications about relevant activity;
- Community discussion: comments, replies, likes, helpful votes, reports, and correction requests.
3.2 The Services are a venue for information sharing. Vivaram does not create most of the content on the platform and does not control, endorse, or pre-verify Community Content except as described in Section 13.
3.3 Community participation is voluntary. You are never obligated to post content, and choosing not to contribute does not limit your ability to browse publicly available information, subject to these Terms.
3.4 We are continually developing the Services. Features may be added, changed, limited, or removed over time, as described in Section 23.
3.5 Automated systems and artificial intelligence. Vivaram may use automated systems, including machine learning and artificial intelligence, to assist with moderation, recommendations, translations, categorization, summarization, spam detection, fraud prevention, accessibility improvements, and other operational purposes. Automated systems assist human decision-making where appropriate and may not be perfect; their outputs may contain errors and are subject to the disclaimers in Section 26.
3.6 Advertising and promoted content. The Services are currently offered without third-party advertising. Vivaram may in the future display advertisements, sponsored content, promoted listings, or other commercial content, and any such content will be identified as such where appropriate. If advertising is introduced, the Privacy Policy will be updated before any related data practices begin.
4. Eligibility
4.1 Minimum age. You must be at least 18 years old to create an Account. The Services are not directed to children under 13, and children under 13 may not use the Services in any manner. If you are between 13 and 18 years old, you may use the Services only with the consent and supervision of a parent or legal guardian who has reviewed and agreed to these Terms on your behalf. By using the Services, you represent that you satisfy the requirement applicable to you under this Section.
4.2 Legal capacity. You must have the legal capacity to enter into a binding agreement in your jurisdiction, or use the Services under the supervision of a parent or legal guardian as described in Section 4.1.
4.3 Compliance with local laws. You may use the Services only in compliance with all laws applicable to you, including local laws governing online conduct, content, and the subject matter you post about. You may not use the Services if you are located in, or a resident of, a jurisdiction where use of the Services would be unlawful, or if you are subject to sanctions or restrictions that prohibit your use.
4.4 Accurate information. You agree to provide accurate, current, and complete information when creating an Account and to keep it updated. Providing false information, or creating an Account in another person's name or identity, is a violation of these Terms.
4.5 One account per person. You may maintain only one Account unless we expressly authorize additional accounts (for example, an authorized organizational or departmental account). Creating multiple accounts to evade enforcement, manipulate engagement, or mislead other users is prohibited and may result in termination of all associated accounts.
4.6 Account responsibility. You are responsible for your Account and for all activity that occurs through it, as further described in Section 5.
4.7 Prior removal. You may not use the Services if we have previously suspended or terminated your Account for violations of these Terms, unless we have expressly reinstated you in writing.
4.8 Right to refuse service. Vivaram reserves the right to refuse access to the Services, or to any feature of the Services, to any person, where permitted by applicable law — including where we reasonably believe the person intends to misuse the Services or has previously violated these Terms.
5. Your Account
5.1 Registration methods. You may create an Account using: (a) an email address and password, verified through a one-time password sent to your email address; or (b) Google Sign-In, subject to Google's own terms and your Google account settings. We do not offer phone number registration, mobile OTP, or SMS verification.
5.2 Credential security. Passwords are stored only in hashed form. You are responsible for maintaining the confidentiality of your password and any other credentials associated with your Account, and for not sharing them with any other person. If you believe your credentials have been compromised, you must change your password and notify us promptly at [email protected].
5.3 Activity under your Account. You are responsible for all activity that occurs under your Account, whether or not you authorized it, to the extent permitted by law. We are not liable for loss or damage arising from your failure to protect your credentials.
5.4 Unauthorized access. You must notify us immediately at [email protected] if you become aware of any unauthorized access to or use of your Account, or any other security breach affecting your Account.
5.5 Account integrity. You may not sell, transfer, lend, or share your Account, and you may not acquire, purchase, or use an Account registered to another person. Usernames and display names may not be misleading, impersonate another person or entity, infringe any trademark or other right, or be offensive or deceptive. We reserve the right to reclaim, suspend, or require changes to any username or display name at any time, including where it violates this Section, infringes a third party's rights, is misleading as to official status (for example, names suggesting a government body or public authority), is inactive, or is needed for operational, legal, trademark, verification, or public-interest reasons.
5.6 Account deletion. You may delete your Account at any time as described in Section 17.4 and in the Privacy Policy.
5.7 Account inactivity. Accounts that remain inactive for an extended period (for example, 24 months) may be deactivated or deleted, and their usernames reclaimed, in accordance with the retention practices described in the Privacy Policy. Where practicable, we will attempt to notify you at your registered email address before taking action on an inactive Account.
6. Guest Access
6.1 You may browse publicly available content on the Services without registering an Account. Guest access is provided for reading and discovery only.
6.2 Guest Users cannot post Community Content, comment, reply, vote, report content, RSVP to events, receive push notifications, or use other account-based features. To use those features, you must create an Account and accept the responsibilities that come with it.
6.3 Guest Users remain bound by these Terms, including the Acceptable Use Policy in Section 10, and by the Privacy Policy to the extent it applies to automatically collected technical information.
6.4 We may limit, restrict, or condition guest access at any time, including by rate-limiting requests or requiring registration for certain content or features.
7. Community Features
7.1 Purpose. The community features of the Services exist to help residents share useful, timely, local information. Each feature has a distinct purpose:
- Naatile Samsaram is for first-hand community reports — local issues, observations, experiences, and matters of neighborhood interest. Submissions may include a title, description, a voluntarily selected location, an anonymity preference, and a municipality or district scope.
- Questions is for asking the community about local topics and receiving answers from other users. Submissions may include question text and an anonymity preference.
- Government Notices is for sharing notices concerning government announcements, schemes, services, and public administration, subject to Section 11.
- Local Events is for publishing and discovering events, including title, description, category, date, time, venue, source, and scope, and for recording RSVPs.
- Comments and replies allow discussion of Community Content.
- Likes and helpful votes allow users to signal appreciation and usefulness, and help surface valuable contributions.
- Reports and correction requests allow users to flag violations and inaccuracies for moderator attention.
- Notifications keep you informed about activity relevant to you, subject to your settings.
7.2 Feature rules. Each feature must be used for its intended purpose. Misusing a feature — for example, posting a question as a report to evade scope rules, or using comments to publish content that would be removed as a post — is a violation of these Terms.
7.3 Voluntary participation. All participation is voluntary. Contributions do not create any entitlement to compensation, attribution beyond what the feature provides, or continued display.
7.4 No guarantee of visibility. We do not guarantee that any content will be displayed, promoted, or seen by any particular audience. Distribution of content may depend on scope, relevance, quality signals, and moderation decisions.
8. User-Generated Content: Ownership and License
8.1 You own your content. You retain all ownership rights you hold in the Community Content you create. These Terms do not transfer ownership of your content to Vivaram, and we claim no ownership over it.
8.2 License you grant us. Community Content cannot technically exist on the platform without certain rights. By submitting, posting, or transmitting Community Content through the Services, you grant Vivaram a worldwide, non-exclusive, royalty-free, sublicensable (solely to service providers acting on our behalf) license to:
- store, host, and cache the content on our systems and those of our infrastructure providers;
- reproduce, display, and distribute the content through the Services, in accordance with the scope and settings you select;
- index the content and make it searchable within the Services;
- adapt, reformat, translate, and modify the content solely for technical purposes, such as formatting for different devices, generating excerpts and previews, and correcting presentation, without altering its substance;
- use the content for moderation, safety, and enforcement purposes, including reviewing it against these Terms;
- use the content to operate, improve, and promote the Services and the content itself within Vivaram — for example, featuring a report in a local digest or highlight.
8.3 Scope of display. The license in Section 8.2 operates within the visibility settings of the feature you use — for example, the municipality or district scope you select, and the anonymity preference you set. We will not publicly attribute an Anonymous Post to you except as described in Section 14 and in the Privacy Policy.
8.4 Duration. The license continues for as long as your content is stored on the Services and ends when you delete the content or your Account, except that the license survives to the extent necessary for: (a) operation of features in which your content is embedded in the contributions of others, such as comment threads; (b) backups, which are purged in the ordinary course as described in the Privacy Policy; (c) legal compliance, preservation obligations, and the establishment or defense of legal claims; and (d) resolving disputes and enforcing these Terms. Content that others have copied or re-shared outside our control cannot be recalled.
8.5 Feedback excluded. Suggestions and feedback you send us are governed by Section 20, not this Section.
8.6 Moral rights and attribution. To the extent permitted by law, you agree that we may exercise the rights in Section 8.2 without providing attribution beyond the display the feature provides, and you waive, or agree not to assert, any moral rights that would prevent the technical uses described in this Section.
9. Your Representations and Responsibilities for Content
9.1 Sole responsibility. You are solely responsible for the Community Content you create, submit, and publish through the Services, and for the consequences of publishing it. Vivaram does not control, pre-screen, endorse, or adopt Community Content, and publication of content on the Services does not mean we approve of it.
9.2 Your representations. Each time you submit Community Content, you represent and warrant that:
- you own the content or have obtained all rights, licenses, consents, and permissions necessary to publish it and to grant the license in Section 8.2;
- the content, and its publication on the Services, does not violate any applicable law, regulation, or order of any court or authority;
- the content does not infringe any copyright, trademark, patent, trade secret, or other intellectual property or proprietary right of any person;
- the content does not violate any person's privacy, publicity, or other personal rights, and does not disclose personal information of others without their consent or another lawful basis;
- the content is not knowingly false or misleading, and where you present information as fact — particularly in Government Notices, emergency-related reports, or public safety information — you have a reasonable basis for believing it to be true;
- where the content references a source, you have identified that source honestly;
- the content complies with these Terms and the Community Guidelines.
9.3 Sensitive subjects. If you post about accidents, crimes, deaths, or identifiable individuals, you are responsible for doing so lawfully, respectfully, and without disclosing information that should not be made public. Information about identifiable private individuals may be removed, and may expose you to legal consequences, even where it is true.
9.4 No professional standing claimed. You may not present yourself through the Services as a government authority, licensed professional, or emergency service unless you genuinely hold that position and are authorized to speak for it. Content you post must not be presented as official professional, legal, medical, or financial advice unless you are qualified and entitled to provide it.
9.5 You bear the risk of your content. Because you control what you publish, you — not Vivaram — bear the legal risk of your content. This is reflected in the indemnification obligations in Section 28.
9.6 Platform role. Vivaram provides an intermediary platform that hosts and transmits content on behalf of users. Vivaram does not originate, select the sender of, or modify the substance of Community Content, and users — not Vivaram — are responsible for the content they publish. Consistent with applicable law, including the Information Technology Act, 2000 and rules made under it, Vivaram may remove or disable access to content upon obtaining actual knowledge of its unlawfulness through a court order, a lawful direction of a government or its agency, or a valid complaint, and may act on its own initiative against content that violates these Terms.
10. Acceptable Use Policy
10.1 Core principle. The Services may be used only for lawful, truthful, and respectful participation in community information sharing. The rules in this Section apply to all users, including Guest Users, and to all conduct on or directed at the Services.
10.2 Prohibited content. You may not create, post, submit, or transmit any content that:
- is spam — unsolicited, repetitive, bulk, or commercially irrelevant material, or content designed primarily to drive traffic elsewhere;
- constitutes or promotes scams, fraud, phishing, deceptive schemes, or financial exploitation;
- impersonates any person, organization, government body, official, or another user, or falsely states or implies affiliation with any of them;
- harasses, bullies, threatens, intimidates, or stalks any person, or incites others to do so;
- promotes, incites, or glorifies violence or physical harm against any person or group;
- constitutes hate speech or promotes discrimination, hostility, or violence based on religion, caste, race, ethnicity, national origin, sex, gender, sexual orientation, disability, or similar protected characteristics;
- is knowingly false or misleading and is shared with intent to deceive, particularly regarding emergencies, public safety, health, elections, or government actions;
- is defamatory — that is, false statements of fact that damage the reputation of an identifiable person or entity;
- is unlawful under any applicable law, or encourages, facilitates, or instructs others in illegal activity;
- is pornographic or sexually explicit, or sexualizes any person without consent;
- depicts, promotes, or facilitates child sexual abuse or exploitation in any form — such content will be removed and reported to appropriate authorities;
- contains graphic or gratuitous violence, gore, or cruelty posted for shock value;
- promotes, supports, or recruits for terrorist or extremist organizations or activities;
- violates any person's privacy, including posting another person's personal information, address, contact details, documents, or images without lawful basis or consent;
- infringes intellectual property or other proprietary rights of any person.
10.3 Prohibited conduct. You may not:
- upload, transmit, or distribute malware, viruses, worms, trojans, spyware, or any other harmful or disruptive code;
- use bots, scripts, scrapers, crawlers, or other automated means to access, collect, or interact with the Services, except with our prior written permission or through interfaces we expressly provide for that purpose;
- create accounts in bulk, or use automated or fraudulent means to create accounts;
- scrape, harvest, or bulk-collect content, user information, or data from the Services without authorization;
- probe, scan, or test the vulnerability of the Services, or breach or circumvent any security, authentication, or access-control measure;
- reverse engineer, decompile, or attempt to extract the source code of the Services, except where such restriction is prohibited by applicable law;
- access or use any non-public application programming interface, or use any interface in excess of rate limits or contrary to its documented purpose;
- interfere with, disrupt, or degrade the Services, servers, or networks — including through denial-of-service activity, excessive load, or exploitation of defects;
- manipulate platform signals, including through fake engagement, coordinated inauthentic behavior, or vote manipulation;
- use the Services to advertise or sell products or services, except where we expressly permit it;
- attempt to evade, or assist others in evading, any enforcement action, suspension, ban, or restriction;
- collect or attempt to collect information about other users for purposes of harassment, profiling, or exploitation;
- misuse the reporting system by submitting knowingly false or bad-faith reports;
- otherwise use the Services in any manner that could damage, disable, overburden, or impair the platform or interfere with any other user's use.
10.4 Enforcement. Violations of this Section are addressed under Sections 15 through 17. The fact that specific conduct is not listed here does not make it acceptable; we reserve the right to address any conduct that harms the Services, users, or third parties.
10.5 Platform integrity. You may not undermine the integrity of the Services or their signals. In particular, you may not:
- engage in brigading — coordinating users, on or off the platform, to target content, accounts, or votes en masse;
- manipulate votes, likes, helpful signals, RSVPs, or any other engagement metric, whether manually, through multiple accounts, or through automation;
- run or participate in coordinated inauthentic campaigns, including campaigns to amplify or suppress particular content or viewpoints through deceptive means;
- create or use fake engagement, sockpuppet accounts, or engagement-exchange schemes;
- repost content that has been removed for violating these Terms, create mirror or near-duplicate posts of removed content, or encourage others to do so;
- falsely claim or imply verification, official status, moderation authority, or endorsement by Vivaram — verification exists only through the platform's own badge system, and any other claim of verification is invalid and prohibited;
- exploit bugs, loopholes, or unintended behavior of the Services for advantage or disruption, rather than reporting them to us.
11. Government Notices
11.1 Open submission. Any registered user may submit a Government Notice. Submission capability does not imply authority, authenticity, or endorsement.
11.2 Not automatically official. A Government Notice on Vivaram is a user submission. It is not issued by Vivaram, and unless and until it receives a Verified Badge, it has not been reviewed for authenticity or accuracy. An unverified notice may be incomplete, outdated, paraphrased incorrectly, or wrong.
11.3 Verification of notices. A notice may receive a Verified Badge only after review by an authorized moderator or administrator, as described in Section 13. Verification reflects that certain review steps were completed at a point in time; it is not a continuing guarantee.
11.4 Your obligations when posting notices. When you submit a Government Notice, you must: (a) identify the source honestly, including the issuing department or authority where known; (b) not fabricate, alter, or misrepresent official communications; (c) not present a notice as issued by you or by Vivaram when it is not; and (d) not claim an official capacity you do not hold. Fabricating government notices is a serious violation of these Terms and may also constitute a criminal offense in some jurisdictions; we may preserve records and report such conduct to authorities.
11.5 Duty to verify independently. Before acting on any Government Notice — verified or not — confirm the information through the relevant authority's official channels, such as the department's official website, office, or published communication. Do not rely on a Vivaram notice for applications, deadlines, payments, travel, legal compliance, or safety decisions without independent confirmation.
11.6 No government affiliation. Vivaram is not a government body, is not affiliated with, endorsed by, or acting on behalf of any government, department, municipality, or public authority, and does not speak for any of them, regardless of any Verified Badge displayed on content.
11.7 Publication rights and attribution. Government and public documents may be publicly accessible without being free to republish in every form. When submitting notices, respect applicable intellectual property and publication rights, reproduce official text faithfully where you quote it, and cite the original source — such as the issuing department's official publication, gazette, or website — whenever known.
12. Reliability of Information on the Platform
12.1 Community reports. Naatile Samsaram reports reflect individual users' experiences, observations, and opinions. They may contain mistakes, omissions, exaggeration, outdated details, or misunderstandings. Vivaram does not investigate or guarantee the accuracy of community reports.
12.2 Public-interest information. Information categories such as weather, market prices, lottery results, electricity outage updates, train timings, and bus timings may originate from users, third-party sources, or public sources, and may change without notice. Specifically:
- Weather information is general in nature and is not a substitute for official meteorological warnings;
- Electricity updates may be community reports of outages and restorations and are not official communications of any electricity board or utility;
- Train and bus timings are subject to change, delay, and cancellation by operators; always confirm with the operator or official schedules before travel;
- Market prices are indicative snapshots that vary by vendor, time, and place; they are not offers, quotations, or financial advice;
- Lottery results must always be confirmed against the official results published by the conducting authority before any claim or decision; Vivaram accepts no responsibility for losses arising from reliance on displayed results.
12.3 Critical information. For any information that could affect your health, safety, rights, property, travel, or finances, verify against official sources before relying on it. This principle applies across the entire platform and is a condition of your use of the Services.
12.4 No endorsement. Display, ranking, featuring, or the application of a Verified Badge does not constitute Vivaram's endorsement, adoption, or guarantee of any content.
12.5 Source attribution. When you contribute information of the kinds described in Section 12.2 — for example, market prices, electricity updates, or transport timings — cite the original source whenever known (such as the utility, operator, market, or official publication). Cited sources help other users verify information and help moderators assess correction requests.
13. Verification
13.1 What may be verified. At our discretion, Verified Badges may be applied to: (a) user accounts, including accounts of public figures or officials; (b) organizations; (c) government departments or authorities; and (d) individual items of content, most notably Government Notices.
13.2 What verification means. Verification means only that Vivaram completed certain internal review steps — which may include examining a cited source, confirming an identity, or checking consistency with known official information — at the time of review. Verification processes vary by category and may evolve.
13.3 Who verifies. Verification is performed only by moderators and administrators designated within the Vivaram Team. Users cannot verify themselves or others, and any claim of verification not displayed through the platform's own badge system is invalid.
13.4 Limits of verification. Verification is not: an endorsement of views; a guarantee of accuracy, completeness, or continued validity; a guarantee of future conduct by the verified party; or a certification by any government or authority. Verified information can become outdated, and verified parties can act contrary to expectations.
13.5 Revocation. We may grant, refuse, suspend, or revoke verification at any time, with or without notice, including where verification was granted in error, where the verified party violates these Terms, or where circumstances change. Verification creates no contractual or other right in any user.
13.6 No reliance substitute. Whether or not a badge appears, Section 11.5 and Section 12.3 apply: independently confirm important information through official channels before relying on it.
14. Anonymous Posts
14.1 Feature. Certain features, including Naatile Samsaram and Questions, allow you to post anonymously. An Anonymous Post hides your name, profile photo, and profile link from other users.
14.2 Not anonymity from Vivaram. Anonymity is a display preference, not a deletion of records. Vivaram internally retains the association between each Anonymous Post and the Account that created it, as described in the Privacy Policy.
14.3 Rules still apply. All of these Terms, including the Acceptable Use Policy, apply fully to Anonymous Posts. Posting anonymously does not reduce your responsibility for your content, and prohibited content posted anonymously will be removed and may result in enforcement against your Account.
14.4 Use of the association. The internal account association may be used for abuse prevention, platform security, fraud investigation, community moderation, and legal compliance — including responding to valid legal requests and court orders — and may be disclosed where legally compelled or where necessary to protect safety and rights, as described in the Privacy Policy.
14.5 Practical limits. Content you post anonymously may still identify you through the details it contains. Choose what you share accordingly.
15. Moderation and Enforcement
15.1 Our authority. To protect the community, the reliability of information, and the integrity of the Services, Vivaram may, acting reasonably and consistent with these Terms and applicable law, take any of the following actions with or without notice:
- remove, refuse to publish, or restrict the visibility of any content;
- edit formatting or presentation of content (without altering its substance) to meet technical or display requirements;
- lock discussions, remove or collapse comments, or disable further interaction on content;
- apply labels, warnings, or interstitials to content;
- limit, suspend, or disable features available to an Account;
- issue warnings to an Account;
- temporarily suspend an Account;
- permanently ban an Account and block re-registration;
- investigate reports, content, accounts, and patterns of activity;
- preserve and disclose information where required by law or necessary to protect safety and rights.
15.2 How moderation works. Moderation combines automated systems — such as spam and abuse detection — with human review by moderators and administrators within the Vivaram Team. User reports are a primary input. We do not pre-screen all content, and the fact that content appears on the Services does not mean it has been reviewed.
15.3 Discretion and no duty. Except where the law provides otherwise, we are not obligated to monitor the Services, to review any particular content, to act on any particular report, or to explain individual enforcement decisions. Our decision not to act in one instance is not a waiver of our right to act in any other instance.
15.4 No liability for moderation. To the extent permitted by law, we are not liable for any action we take, or decline to take, in good faith to enforce these Terms — including removal of content, restriction of accounts, or decisions on reports and appeals.
15.5 Investigation. Vivaram may investigate suspected violations of these Terms before, or instead of, taking enforcement action, and may suspend or restrict an Account or content while an investigation is pending where we consider it appropriate.
15.6 Law enforcement and legal requests. Vivaram may preserve or disclose information in response to valid legal requests, court orders, or lawful government directions, or where we reasonably believe disclosure is necessary to prevent imminent harm, in each case in accordance with applicable law and the Privacy Policy. We may preserve content, account information, and related records beyond ordinary retention periods where reasonably necessary for legal proceedings, investigations, or enforcement.
15.7 Moderation actions are platform actions. Moderation and enforcement actions taken in good faith by moderators or administrators acting in their designated roles are actions of the platform under these Terms. Individual moderators and administrators act on behalf of Vivaram, not in their personal capacity.
15.8 Records. We may retain moderation logs, enforcement history, and appeal records for security, abuse prevention, legal compliance, and the improvement of moderation, as described in the Privacy Policy.
15.9 Evolving practices. Our moderation practices, tools, and standards may evolve over time as we work to improve trust and safety. Material changes to the rules themselves will be reflected in updates to these Terms or the Community Guidelines.
16. Reporting Content and Appeals
16.1 Reporting. The Services provide tools to report content and accounts that may violate these Terms, and to request corrections to inaccurate content. Reports are reviewed by moderators or administrators and are not visible to the public. We do not disclose a reporter's identity to the reported user except where the law requires.
16.2 Good faith. Submit reports honestly and in good faith. Knowingly false, malicious, or abusive use of the reporting system is itself a violation of these Terms.
16.3 Appeals. If your content is removed or your Account is suspended or banned, you may contact us at [email protected] to request a review of the decision, stating the reasons you believe the decision was wrong. Where practicable, appeals are reviewed by someone other than the original decision-maker. Appeals are a courtesy process we choose to offer; except where applicable law grants you a formal right of redress, we do not guarantee an appeal, a particular timeline, or a particular outcome. Our decision following review is final to the extent permitted by law.
16.4 Emergencies. Vivaram is not an emergency service, and the Services must not be used as a substitute for one. If content or circumstances involve an emergency or an imminent risk of harm, contact the appropriate authorities first — such as the police, fire services, ambulance services, or disaster management authorities — before or instead of relying on the Services. Reporting content to us is not a substitute for contacting appropriate authorities.
17. Suspension and Termination
17.1 By Vivaram. We may suspend, restrict, or terminate your Account, or your access to any part of the Services, at any time, with or without notice, where we reasonably believe that:
- you have violated these Terms, the Community Guidelines, or applicable law;
- your Account is used for fraud, spam, impersonation, abuse, or illegal conduct;
- your activity creates risk of harm to other users, third parties, or the Services;
- your Account poses a security risk;
- we are required to do so by law, court order, or governmental authority; or
- continued provision of the Services to you is no longer practicable, including if we discontinue the Services.
17.2 Effect of termination. Upon termination: your right to access and use the Services ends immediately; your profile and content may be removed or anonymized as described in the Privacy Policy; and any licenses you granted us survive only as described in Section 8.4. Termination does not entitle you to any compensation.
17.3 No evasion. You may not create or use another Account to circumvent a suspension or ban. Attempts to evade enforcement may result in permanent exclusion from the Services.
17.4 By you. You may stop using the Services at any time and may permanently delete your Account through the account settings or by contacting us at [email protected]. Account deletion is governed by the Privacy Policy, including its provisions on retained information and backups.
17.5 Survival. Provisions of these Terms that by their nature should survive termination — including Sections 8.4, 9, 12, 18, 20, 26, 27, 28, 29, and 30 — survive termination of your Account and of these Terms.
18. Our Intellectual Property
18.1 Platform ownership. Unless otherwise agreed in writing, all intellectual property rights in the Vivaram platform are owned by Muhammed Rijas. This includes: the Vivaram name and brand; logos, marks, and trade dress; the design, look and feel, and user interface of the Services; software and source code; graphics, icons, and visual assets; documentation; databases and their structure; algorithms, ranking and recommendation logic; and all improvements and derivatives of the foregoing, except for Community Content owned by users. Contributors to the platform retain ownership only of their own independent contributions, except to the extent those rights are assigned or licensed to Vivaram by agreement.
18.2 Limited license to you. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for their intended personal, non-commercial purposes. This license does not include any right to: copy, modify, distribute, sell, or lease any part of the Services; extract source code except as permitted by law; use the Vivaram name, logo, or brand without our prior written permission; or frame, mirror, or republish the Services.
18.3 Reservation of rights. All rights not expressly granted in these Terms are reserved. No implied licenses are granted.
18.4 Brand use. You may not use the Vivaram name, logo, or brand in any way that suggests affiliation, sponsorship, or endorsement without our prior written consent, except for truthful, minimal references to the platform by name.
18.5 Open-source components. The Services may include third-party open-source software components. Those components are governed by their respective open-source licenses, and nothing in these Terms limits your rights, or grants you rights that supersede the obligations, under those licenses.
19. Copyright Infringement Policy and Legal Removal Requests
19.1 Respect for copyright. We respect the intellectual property rights of others and expect users to do the same. We respond to notices of alleged copyright infringement that comply with applicable law.
19.2 Submitting a complaint. If you believe that content on the Services infringes your copyright, send a written notice to [email protected] with the subject "Copyright Complaint," including:
- identification of the copyrighted work you claim has been infringed;
- identification of the allegedly infringing content, with sufficient detail (such as a link or screenshot reference) for us to locate it;
- your name, address, and email address;
- a statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
- a declaration, made in good faith under applicable law, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf; and
- your physical or electronic signature.
19.3 Action on complaints. Upon receiving a compliant notice, we may remove or disable access to the allegedly infringing content, notify the user who posted it, and take further action as appropriate, including under Section 19.5.
19.4 Counter-notification. If you believe your content was removed by mistake or misidentification — for example, that you own the content or your use is authorized or lawful — you may send a counter-notification to [email protected] including: identification of the removed content and where it appeared; your contact information; a declaration, made in good faith under applicable law, that you believe the content was removed by mistake or misidentification; your consent to the jurisdiction of the courts identified in Section 29; and your physical or electronic signature. Where permitted by law, we may forward your counter-notification to the complainant and restore the content unless the complainant initiates legal proceedings within the period provided by applicable law.
19.5 Repeat infringers. We maintain a policy of terminating, in appropriate circumstances, the Accounts of users who are repeat infringers of intellectual property rights.
19.6 Misuse. Knowingly submitting a false infringement notice or counter-notification may expose you to liability for damages and costs, and is a violation of these Terms.
19.7 Trademark complaints. If you believe content on the Services misuses a trademark, logo, or official emblem — for example, the logo of a government body, utility, transport operator, or business, used in a way that is misleading or infringing — you may submit a complaint to [email protected] with the subject "Trademark Complaint," identifying the mark, the content, and the basis of your complaint. We will review and act as appropriate under applicable law.
19.8 Other legal removal requests. Users and third parties may also contact us regarding content they believe is unlawful or rights-infringing on other grounds — for example, defamation, privacy violations, identity theft or impersonation, non-consensual intimate content, fabricated government notices, or content subject to a court order or lawful government direction. Send such requests to [email protected] with enough detail to identify the content and the legal basis of the concern. We may review, remove, restrict access to, label, or preserve the content, and take account-level action, as appropriate and in accordance with applicable law, including the Information Technology Act, 2000 and rules made under it.
19.9 Preservation. Where reasonably necessary for legal proceedings, investigations, enforcement, or compliance with law, we may preserve content and account information beyond the ordinary retention periods described in the Privacy Policy.
20. Feedback
20.1 If you send us ideas, suggestions, feature requests, or other feedback about the Services ("Feedback"), you agree that: (a) your Feedback is provided voluntarily and without expectation of compensation; (b) we may use, implement, modify, and build upon your Feedback for any purpose, without restriction and without any obligation to you, including confidentiality or attribution; (c) we are under no obligation to review, implement, or respond to any Feedback; and (d) Feedback does not include your Community Content, which remains governed by Section 8. If you do not want your Feedback used freely, do not submit it.
21. Beta and Experimental Features
21.1 From time to time we may offer features that are in testing, preview, beta, or otherwise experimental ("Beta Features"). Beta Features may be incomplete, unstable, changed without notice, or discontinued entirely, and may be offered to limited groups of users.
21.2 Beta Features are provided "as is" and "as available," without warranties of any kind, and the disclaimers and limitations in Sections 26 and 27 apply to them fully. Information about Beta Features that is not publicly available is confidential to Vivaram, and you agree not to disclose it where we ask you to keep it confidential.
21.3 Remote configuration tools may be used to enable, disable, or adjust features for different users or regions. The availability of a feature to another user does not entitle you to it.
22. Third-Party Services and Links
22.1 Providers we use. The Services rely on third-party providers, including Firebase (Google) for analytics, crash reporting, push notifications, and remote configuration; Google Sign-In for authentication; Cloudflare for storage infrastructure; and MapTiler for location search and geocoding. Your use of those components may be subject to the provider's own terms and privacy policies.
22.2 Third-party links and content. Community Content and notices may reference or link to third-party websites, government portals, applications, or services that we do not operate or control. We are not responsible for third-party sites, services, or content — including their accuracy, legality, availability, or practices — and a link or reference on the Services is not an endorsement.
22.3 Your dealings with third parties. Any interaction, transaction, or dispute between you and a third party — including event organizers, government authorities, transport operators, utilities, or businesses mentioned on the Services — is solely between you and that third party. We are not a party to those dealings and bear no responsibility for them.
22.4 No responsibility for providers. To the extent permitted by law, we are not liable for acts, omissions, outages, or failures of third-party providers, and your recourse for their services lies with them.
22.5 Infrastructure changes. We may change, add, or replace service providers, infrastructure, hosting, and technical components at any time as the Services evolve, without requiring new acceptance of these Terms for each such change, provided that Personal Information continues to be handled in accordance with the Privacy Policy. Material changes to how Personal Information is processed will be reflected in an updated Privacy Policy.
23. Availability, Changes, and Discontinuation of the Services
23.1 No guaranteed availability. The Services are provided on an "as available" basis. They may be interrupted, suspended, or unavailable from time to time, including for maintenance, upgrades, repairs, security incidents, infrastructure failures, or causes beyond our control. We do not warrant uninterrupted, timely, secure, or error-free operation.
23.2 Changes. We may add, modify, suspend, or remove features or functionality at any time, with or without notice, including changing scopes, limits, or eligibility for features.
23.3 Discontinuation. We may discontinue the Services, in whole or in part, at any time. Where practicable, we will provide reasonable advance notice of a full discontinuation, but we are not obligated to do so and will not be liable for modification, suspension, or discontinuation of the Services or any feature.
23.4 Data on discontinuation. If the Services are discontinued, content and Account data will be handled in accordance with the Privacy Policy and applicable law. We recommend not using the Services as your sole repository for any information you cannot afford to lose.
24. Privacy and Data Protection
24.1 Privacy Policy. Your privacy matters. The Privacy Policy explains what information we collect, how we use and share it, how long we keep it, and the rights and choices you have. The Privacy Policy is incorporated into and forms part of these Terms. By using the Services, you also agree to the Privacy Policy.
24.2 Data practices in brief. Among other things described in the Privacy Policy: registration uses email verification or Google Sign-In; we do not track your location or build movement history; locations attached to content are ones you deliberately select; Community Content may be public; and Anonymous Posts hide your identity from other users but not from Vivaram.
24.3 Retention. We retain information as described in the Privacy Policy, including limited retention after Account deletion for legal compliance, fraud prevention, platform security, dispute resolution, and backup cycles.
24.4 Other people's data. You must not publish another person's personal information through the Services without lawful basis or consent, and you must not use information obtained through the Services to process others' personal data in violation of law.
25. Security Responsibilities
25.1 Our measures. We implement technical and organizational measures designed to protect the Services and user information, as described in the Privacy Policy. No system is perfectly secure, and we cannot guarantee absolute security.
25.2 Your responsibilities. You are responsible for: using a strong, unique password; keeping your credentials confidential; keeping your device, operating system, and the app updated; signing out on shared devices; and using the Services only over networks you reasonably trust.
25.3 Reporting security issues. If you discover a vulnerability or security issue affecting the Services, report it to [email protected] promptly and do not exploit it, disclose it publicly before we have had a reasonable opportunity to address it, or access data that is not yours. Good-faith security research reported responsibly will not be treated as a violation of these Terms, provided it complies with Section 10.3 and causes no harm to users or the Services.
26. Disclaimers
26.1 "As is" and "as available." To the maximum extent permitted by applicable law, the Services and all content on them are provided "as is" and "as available," with all faults and without warranty of any kind. Vivaram expressly disclaims all warranties and conditions, whether express, implied, statutory, or otherwise, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade.
26.2 No accuracy warranty. Without limiting Section 26.1, Vivaram makes no representation or warranty that:
- any content on the Services — including Community Content, Government Notices, community reports, event listings, weather information, market prices, lottery results, electricity updates, train timings, or bus timings — is accurate, complete, current, reliable, or suitable for any purpose;
- the Services will be uninterrupted, timely, secure, or error-free;
- defects will be corrected;
- the Services or the infrastructure behind them are free of viruses or other harmful components; or
- any information obtained through the Services will meet your expectations or requirements.
26.3 Community content disclaimer. Community Content represents the views of its authors, not of Vivaram. Vivaram does not control, endorse, verify (except as described in Section 13), or adopt Community Content, and assumes no responsibility or liability for it or for your reliance on it.
26.4 Official information disclaimer. Nothing on the Services is an official communication of any government, authority, utility, transport operator, or other body unless that body is itself the publisher and is verified as such, and even then independent confirmation is required under Sections 11.5 and 12.3.
26.5 No professional advice. Content on the Services is for general informational purposes only and does not constitute legal, medical, financial, safety, or other professional advice. Consult a qualified professional for advice specific to your situation.
26.6 Your reliance is at your risk. Any reliance you place on information obtained through the Services is strictly at your own risk. You are solely responsible for verifying information before acting on it.
26.7 Jurisdictional limits. Some jurisdictions do not allow the exclusion of certain warranties. To the extent such law applies, the exclusions in this Section apply to the fullest extent permitted, and nothing in these Terms excludes a warranty that cannot lawfully be excluded.
27. Limitation of Liability
27.1 Excluded damages. To the maximum extent permitted by applicable law, in no event will Vivaram, Muhammed Rijas, the Vivaram Team, or their contributors, volunteers, moderators, or service providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, goodwill, data, or business opportunity, arising out of or relating to these Terms or your use of, or inability to use, the Services, even if advised of the possibility of such damages.
27.2 Covered claims. Without limiting Section 27.1, the limitations in this Section apply to claims arising from or relating to: Community Content or other user-generated content, including its inaccuracy or your reliance on it; the conduct or content of other users or third parties, whether online or offline; service interruptions, outages, downtime, or discontinuation; loss, corruption, or unauthorized access to data; inaccurate, incomplete, or outdated information of any kind displayed on the Services; third-party services, providers, websites, or links; unauthorized access to or alteration of your Account or transmissions; bugs, errors, or defects in the Services; enforcement or moderation decisions, including removal of content or suspension of accounts; and events beyond our reasonable control.
27.3 Liability cap. To the maximum extent permitted by applicable law, the total aggregate liability of Vivaram, Muhammed Rijas, and the Vivaram Team arising out of or relating to these Terms or the Services will not exceed the greater of: (a) the amount you paid us, if any, to use the Services in the twelve months preceding the event giving rise to the claim; or (b) ₹5,000 (Indian Rupees Five Thousand). Because the Services are currently provided free of charge, you acknowledge that this cap reflects a reasonable allocation of risk.
27.4 Basis of the bargain. You acknowledge that the disclaimers and limitations in Sections 26 and 27 are fundamental elements of the agreement between you and Vivaram, that the Services would not be provided without them, and that they apply regardless of the theory of liability — contract, tort, negligence, strict liability, statute, or otherwise.
27.5 Liability that cannot be excluded. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or willful misconduct, or any statutory consumer right that cannot lawfully be waived.
28. Indemnification
28.1 To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Vivaram, Muhammed Rijas, and the Vivaram Team — including contributors, volunteers, and moderators — from and against any and all claims, demands, actions, damages, losses, liabilities, judgments, settlements, costs, and expenses (including reasonable legal fees) arising out of or relating to:
- your Community Content, including any claim that it infringes intellectual property rights, violates privacy or publicity rights, is defamatory, or is otherwise unlawful;
- your conduct on or through the Services;
- your violation of these Terms, the Community Guidelines, or applicable law;
- your violation of any right of any person or entity;
- your misuse of the Services, including any activity described in Section 10.3;
- any misrepresentation you make in connection with the Services, including false claims of identity, authority, or affiliation; and
- any activity occurring under your Account.
28.2 We reserve the right, at your expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense. You may not settle any claim in a manner that imposes any obligation or admission on Vivaram without our prior written consent.
29. Governing Law and Dispute Resolution
29.1 Governing law. These Terms, and any dispute or claim arising out of or relating to them or the Services, are governed by the laws of India and, where state law applies, the laws of Kerala, without regard to conflict-of-law principles. Mandatory consumer-protection provisions of your place of residence remain unaffected where the law so provides.
29.2 Informal resolution first. Before filing any formal claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally. Most concerns can be resolved this way. You and we will attempt in good faith to resolve any dispute for at least thirty (30) days from written notice of the dispute before either party initiates formal proceedings, except where a party seeks urgent injunctive or equitable relief or where applicable law provides otherwise.
29.3 Courts. Subject to Section 29.2 and to any mandatory jurisdiction conferred by applicable law, the courts located at Kannur, Kerala will have exclusive jurisdiction over disputes arising out of or relating to these Terms or the Services, and you and we consent to the personal jurisdiction of those courts.
29.4 Time limit. To the extent permitted by applicable law, any claim arising out of or relating to these Terms or the Services must be brought within one (1) year after the claim arose, or it is permanently barred. This does not apply where the law prohibits shortening a limitations period.
29.5 Injunctive relief. You agree that breach of Sections 10 or 18 may cause irreparable harm for which damages would be an inadequate remedy, and that we may seek injunctive or equitable relief in addition to other remedies.
30. General Legal Terms
30.1 Entire agreement. These Terms, together with the Privacy Policy, the Community Guidelines, and any feature-specific terms you accept, constitute the entire agreement between you and Vivaram regarding the Services and supersede all prior or contemporaneous understandings on the same subject.
30.2 Severability. If any provision of these Terms is held invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permissible, or modified to give effect to its intent, and the remaining provisions will continue in full force and effect.
30.3 No waiver. Our failure or delay to enforce any provision of these Terms is not a waiver of that provision or of our right to enforce it later. A waiver is effective only if in writing and signed by us, and applies only to the specific instance given.
30.4 Assignment. You may not assign or transfer these Terms, or any rights or obligations under them, without our prior written consent. We may assign these Terms, in whole or in part, without your consent, including in connection with a transfer of the platform, the incorporation of an entity to operate Vivaram, or a merger, acquisition, or reorganization. If Vivaram's operations are transferred to a successor entity, these Terms will continue to apply between you and that successor, and your rights under these Terms will not be reduced by the transfer itself. These Terms bind and benefit the parties and their respective successors and permitted assigns.
30.5 Force majeure. We are not liable for any delay or failure to perform resulting from causes beyond our reasonable control, including natural disasters, epidemics, war, civil disturbance, strikes, utility or telecommunications failures, internet or cloud-infrastructure outages, cyberattacks, ransomware or other malicious activity targeting infrastructure, governmental actions, or acts of third parties.
30.6 Electronic communications and records. You agree to receive communications from us electronically — by email, push notification, or notices within the Services — and you agree that electronic communications, agreements, notices, and records satisfy any legal requirement that communications be in writing. You consent to the use of electronic signatures and records in connection with these Terms. Keep your registered email address current; notices sent to it are deemed received.
30.7 No agency. Nothing in these Terms creates any agency, partnership, joint venture, fiduciary, or employment relationship between you and Vivaram. You have no authority to bind Vivaram in any way.
30.8 Third-party beneficiaries. Except as expressly stated for the persons protected by Sections 27 and 28, there are no third-party beneficiaries to these Terms.
30.9 Language. These Terms are drafted in English. If a translation is provided, it is for convenience only, and the English version governs to the extent permitted by law.
30.10 Export and sanctions compliance. You represent that you are not subject to sanctions or export restrictions that would prohibit your use of the Services, and you will not use the Services in violation of applicable export-control or sanctions laws.
30.11 Accessibility. We aim to make the Services usable by as many people as reasonably possible and welcome reports of accessibility barriers at [email protected].
30.12 Consumer rights preserved. Nothing in these Terms is intended to limit, exclude, or waive any mandatory statutory right you hold as a consumer under the laws of your jurisdiction, including rights under applicable consumer-protection legislation.
30.13 Reservation of rights. All rights not expressly granted to you in these Terms are reserved by Vivaram.
30.14 Survival. Provisions that by their nature should survive — including ownership, licenses granted for surviving purposes, disclaimers, limitations of liability, indemnification, governing law, and dispute resolution — survive any termination or expiration of these Terms.
31. Changes to These Terms
31.1 We may modify these Terms from time to time as the Services evolve or as law requires. When we do, we will update the "Last Updated" date above.
31.2 For material changes, we will provide reasonable advance notice before the changes take effect — for example, through a notice in the app, an email to your registered address, or a notice on our website — except where a change must take effect immediately for legal, security, or safety reasons.
31.3 By continuing to access or use the Services after the updated Terms take effect, you accept the updated Terms. If you do not agree to the updated Terms, you must stop using the Services and may delete your Account under Section 17.4 before the effective date.
31.4 We encourage you to review these Terms periodically. The version in effect at the time of your use governs that use.
